Yes, the restaurant is named after the song, haven't seen the contract agreement between the Stones and the restautant corp but I doubt the Stones give anything away for free...have you seen their ticket prices lately? COWABUNGA DUDE!

song lyrics and song titles are copyrighted not trademark applied for. The name ruby tuesday and logo is a trademark. I am pretty sure that there is no prior trademark for ruby tuesday as Idon't think the stones have trademarked thenames of their songs very diligently. If anything there is probably a long agon agreed upon license between the restaurant chain and the owner of rolling stones trademarks.

I went to the one of these (rip this) joints a few years ago in buffalo, in some huge shopping centre.

We went there after seeing the sign and I insisted. Good food, I had a baked potato that was the size of my car, and it came with a buffet/salad cart, and it was just ridiculous what they had there. As is usual with the US (im from the UK) everything was bigger, and the selection was nuts... More cheese, meats and salad than you could shake a stick at...

I still have the little flag/cocktail stick somewhere that i kept as a stupid souvenir.

I'm not sure Stones approval was needed, it may have been out of their hands. Allen Klein owns the rights to their early songs. So, when you see pre-"Sticky Fingers" songs in ads, it's Klein's doing. The Stones get money, but they don't have control. I'd assume Klein would be in on this, too, if approval were necessary.
